Respecting your Information

1. APPLICATION

The GWD Group of Companies (referred to as “we”, “our”, or “us”) is committed to protecting the privacy of any personal information provided to us.

This Privacy Policy (“Policy”) applies to our collection, use and disclosure of personal information in relation to customers or prospective customers. Personal information is information about an identifiable individual and includes any information about you that identifies you, or by which your identity can be reasonably ascertained (“Personal Information”).

This Policy is governed by New Zealand law and has been prepared in accordance with the Privacy Act 2020 (“Privacy Act”). This Policy must be read in conjunction with our Conditions of Sale. In the event of conflict between this Policy and any other terms and conditions, including our Conditions of Sale, this Policy shall prevail.

2. COLLECTION OF PERSONAL INFORMATION

Where possible we will collect Personal Information directly from you. We may also collect Personal Information about you from a variety of other sources, including when you use our website or deal with any of our team in branch, over the telephone, by txt message or by letter or e-mail or through providing you with goods or services based on instructions we receive from you.

Personal Information collected by us may include your title, name, company name, email address, telephone number, postal or physical address, location, vehicle registration number plate, any relevant details of your motor vehicle, any previous interactions with us, billing information, product and service purchases and preferences, and any other Personal Information that you provide us to enable us to provide you with goods and services based on your instructions.

Our third-party vehicle goods and service providers including Toyota New Zealand, Holden New Zealand, MG New Zealand, Hyundai New Zealand, and Renault New Zealand may require certain Personal Information to be provided to them for us to complete services you have engaged us to provide you.

You may decide not to provide your Personal Information to us however, if you do not provide your Personal Information (or if you provide incorrect Personal Information), we or our third-party service providers might not be able to provide you with access to certain information, products, or services such as warranty and/or motor vehicle sale services to you. If you choose not to provide information required by the New Zealand Transport Authority (“NZTA”) we will be unable to register or complete warrant of fitness inspections on your motor vehicle.

3. USE OF PERSONAL INFORMATION

When you provide us with Personal Information, we are obliged to comply with the provisions of the Privacy Act and will only collect, hold, use and disclose that information in accordance with the principles set out in the Act.

We collect your Personal Information for many reasons including, but not limited to:

a) Providing you with a complete customer service experience ;

b) providing you with services you have engaged us for and increasing the quality of those services;

c) registering vehicles sold with NZTA;

d) sending you reminder notifications for vehicle warranties, servicing, warrant of fitness inspections and other general services for your motor vehicle;

e) sending email marketing (if you have given your consent for us to do so);

f) making decisions in respect of your requests including whether to allow you to open a charge account with us;

g) monitoring and developing our website and any related services;

h) assessing charge account authorisations;

i) carrying out internal research and development;

j) analysing website usage, trends and statistics;

k) supplying you with further information concerning products and services which may be of interest to you; and

l) any other use that is authorised by you or is notified to you at the time of collection.

4. COLLECTION FROM OUR WEBSITE

When you visit our website, we may use automated tools and methods (such as cookies, sessions, and website statistics software) to collect certain information about your visit including:

a) the internet protocol address and host name used by your computer to connect to our website;

b) the operating system and the browser your computer uses;

c) the search engine or inbound hyperlink you used to reach our website; and

d) the date, time, and duration of your visit.

Cookies are small text files that are placed on your browser by the websites you visit. We may use cookies to:

a) enable us to improve the content, reliability, and functionality of our website;

b) enable you to use certain services or functionality;

c) evaluate the effectiveness of the advertising on our website; and

d) track website usage patterns.

Accepting cookies will not give us access to any data on your computer other than the data stored in the cookie. You may configure your web browser to not accept cookies, but you may experience a loss of functionality as a result and some information and services we provide may be unavailable.

Our website uses Google Analytics, a service which transmits website traffic data to Google servers in the United States. Google Analytics does not identify individual users or associate your IP address with any other data held by Google. We use reports provided by Google Analytics to help us understand website traffic and webpage usage. By using our website you consent to the processing of data about you by Google in the manner described in “How Google uses data when you use our partners' sites or apps” which you can read at www.google.com/policies/privacy/partners.

5. DISCLOSURE OF PERSONAL INFORMATION

We may only disclose or release Personal Information to a third-party where we are required by or permitted by the Privacy Act or other applicable law, or disclosure is permitted by this Policy, or you have authorised its release or disclosure, or where for the purpose (or a directly related purpose) for which the Personal Information was collected. We will not otherwise sell, licence or lease your Personal Information.

We may share your Personal Information within the GWD Group of Companies and with our employees and third-party contractors where disclosure is necessary to provide you with goods or services with the relevant respective third-party including Toyota New Zealand, Holden New Zealand, MG New Zealand, Hyundai New Zealand, and Renault New Zealand to maintain vehicle warranties, recalls and general information. We may also share Personal Information with the NZTA to meet our obligations under the Land Transport Act 1998 as a vehicle dealer and issuing agent. You consent to the disclosure of Personal Information as set out in this paragraph.

6. UNSUBSCRIBING TO MARKETING OR ELECTRONIC MESSAGES

Where you have requested or authorised us to send you electronic messages (for example: subscribing to our mailing or marketing list or receiving information concerning services which may be of interest to you). Where you have requested or authorised us to send you electronic messages you consent to your name and contact details being added to the applicable list on our database and consent to receiving commercial messages from us.

All commercial electronic messages will contain an unsubscribe function or you can request us to stop sending you such messages by contacting our Customer Service team using the details listed at the bottom of this Policy

Once we have received your request we will, as soon as practicable, comply with that request but in any event in accordance with our obligations under the Unsolicited Electronic Messages Act 2007.

7. PERSONAL INFORMATION ABOUT OTHER PEOPLE

You must not provide Personal Information to us about another person, unless that person has authorised us, through you, to collect, use and disclose Personal Information about that person, for the purposes described in this Policy.

8. ACCESS AND CORRECTION

It is important to us that your Personal Information held by us is accurate, complete, and current. You can request access to your Personal Information we hold. Further, you are entitled to request that your Personal Information is updated or corrected.

We will disclose Personal Information to the relevant individual to which it relates where that Personal Information can be readily retrieved unless there is a good reason in accordance with the Privacy Act or any other applicable law for not doing so. For example, we may refuse you access to your Personal Information where doing so would breach another person(s) privacy.

If we refuse to provide you with access to your Personal Information, we will provide you with reasons for the refusal, in accordance with the requirements of the Privacy Act.

Where you request us to correct or update your Personal Information we will do so where we think it is reasonable. Where we do not update your Personal Information, you can request us to attach a statement of correction sought, but not made to the relevant Personal Information.

To request access to and update or correction of your Personal Information held by us, you may contact our Privacy Officer or Customer Service team using the details listed at the bottom of this Policy.

9. STORAGE AND SECURITY

When you provide us with Personal Information, you agree that we, and any third party authorised by this Policy may collect, store, and use that Personal Information.

We keep your Personal Information stored on our secured database. We will take reasonable steps to ensure your Personal Information is securely and safely stored including taking reasonable steps to ensure the security of our database and passwords.

No data transmissions over the internet can be guaranteed as completely secure. We make no warranty or guarantee the security of information transmitted from or to you. To the maximum extent permitted by law we disclaim all liability against any misuse, loss, unauthorised access, modification, or disclosure of your Personal Information as a result of unsecure communications between yourself and us. Once we have received your Personal Information, we will use reasonable efforts to protect that information against loss or misuse and against unauthorised access, use, modification, or disclosure.

We will only hold your Personal Information for the duration it is required, for the purpose(s) for which it was collected. Once we no longer require your Personal Information for the purposes for which it was collected, we will securely delete your Personal Information within a reasonable timeframe.

11. CHANGES TO THIS POLICY

We reserve the right, at our discretion, to update or revise this Policy at any time. Changes to this Policy will take effect immediately once they are published on our website. Please check this Policy as published on our website regularly for modifications and updates. By continuing to use our services, products and website or providing any Personal Information after we publish changes to this Policy, you agree to be bound by this Policy as revised.
